Terms of Service

1. Acceptance of Terms
By accessing or using the Dartt ride marketplace platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. The Service is operated by Dartt Technologies Ltd, a company registered in England and Wales.
2. Service Description
Dartt is a technology platform that connects passengers with independent, licensed private hire drivers through a real-time bidding marketplace. Dartt does not provide transportation services directly. Drivers using the platform are independent contractors, not employees of Dartt.
3. Eligibility
You must be at least 18 years old to use the Service. By registering, you represent that you have the legal capacity to enter into a binding agreement. Drivers must hold a valid UK private hire vehicle (PHV) licence issued by the relevant local authority and meet all regulatory requirements.
4. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorised use.
5. Ride Bidding & Pricing
Fares are determined through real-time bidding between drivers and passengers. The displayed fare estimate is indicative only. The final price is agreed upon through the bid acceptance process. Dartt does not apply surge multipliers to fares. Additional charges may apply as follows:
- Waiting time: If a driver waits at the pickup location, the first 5 minutes are free. After that, a charge of 30p per minute applies.
- Platform fee: Dartt charges a 10% platform commission on the agreed fare. This is deducted from the driver's payout, not added to the passenger's fare.
6. Payments
All payments are processed through our payment processor, Stripe. By using the Service, you authorise Dartt to charge your registered payment method for rides, tips, cancellation fees, and any other applicable charges. Drivers receive payouts after deduction of the platform commission (currently 10%). Refund requests are handled in accordance with our refund policy.
Tips: Passengers may add a tip after any completed ride. 100% of tips are paid to the driver — Dartt does not take a commission on tips.
Wallet: You may pre-load funds into your Dartt wallet using a saved payment method. Wallet balances are non-transferable, cannot be withdrawn as cash, and are applied automatically to ride payments. Unused wallet balances will be refunded to your original payment method upon account deletion.
7. Cancellation Policy
Passengers may cancel a ride before a driver has been dispatched without charge. Cancellations after a driver has accepted and been dispatched will incur a cancellation fee of £5 to compensate the driver for their time and fuel. Drivers who cancel accepted rides repeatedly may face account restrictions.
8. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass, threaten, or discriminate against other users
- Provide false or misleading information
- Attempt to manipulate the bidding system or pricing
- Use automated tools to interact with the Service
- Interfere with or disrupt the Service or its servers
- Impersonate any person or entity
9. Driver Obligations
Drivers must maintain valid insurance, vehicle inspections, and all licences required by law. Drivers must complete rides accepted through the platform unless safety concerns arise. Drivers are responsible for their own tax obligations, including self-assessment and National Insurance contributions.
10. Safety
Dartt provides safety features including SOS alerts, trip sharing, driver verification, and background checks. While we take reasonable steps to verify driver identities and credentials, we do not guarantee the actions of any user. You use the Service at your own risk.
11. Ratings & Reviews
Users may rate and review each other after completed rides. Ratings are used to maintain service quality and inform the matching algorithm. Abusive or fraudulent ratings may be removed at our discretion. Users whose ratings fall below acceptable thresholds may face account restrictions.
12. Intellectual Property
All content, trademarks, and technology used in the Service are the property of Dartt Technologies Ltd or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.
13. Limitation of Liability
To the maximum extent permitted by law, Dartt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you to Dartt in the 12 months preceding the claim.
14. Dispute Resolution
Any disputes arising from or relating to these Terms or your use of the Service shall be governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where prohibited by consumer protection law.
Alternative dispute resolution (ADR): Under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we are required to inform you that we do not currently participate in any alternative dispute resolution scheme. If you are unable to resolve a complaint directly with us, you may wish to contact the relevant ADR provider or seek advice from Citizens Advice (citizensadvice.org.uk).
15. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive will continue in effect.
16. Referral Programme
Dartt may offer a referral programme that rewards users for introducing new riders or drivers. Referral credits (currently £5 per qualifying referral) are added to your wallet balance and subject to a maximum of 50 referrals per user. Referral credits cannot be withdrawn as cash. Dartt reserves the right to modify or discontinue the referral programme at any time, and to revoke credits obtained through abuse or fraud.
17. Indemnification
You agree to indemnify, defend, and hold harmless Dartt Technologies Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
18. Force Majeure
Dartt shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, power failures, internet outages, or third-party service disruptions.
19. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dartt Technologies Ltd regarding your use of the Service and supersede all prior agreements, representations, and understandings.
21. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 30 days before the changes take effect. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service.
